These Miranda Rights should be recited to the person being advised as written.
Basic Miranda Rights
- “You have been arrested or detained in connection with the investigation or commission of a crime, more specifically – [Indicate the crime for which the person is under investigation]."
- “You have the right to remain silent. “
- “Anything you say can be used against you in a court of law.”
- “You have the right to an attorney.”
- “If you cannot afford an attorney, one will be appointed for you, prior to and during any questioning, if you wish.”
- “You can decide, at any time, to exercise these rights and not answer any questions or make any statements.”
- “Do you understand the rights I have read and explained to you?”
- “Having these rights in mind, do you wish to talk to me/us now?”
For a Juvenile
REMINDER to officers: A juvenile suspect who is being interviewed or interrogated must be allowed to engage in a meaningful consultation with an attorney or an informed parent or guardian before the juvenile can legally waive the right to counsel and the privilege against self-incrimination.
- “If you are under the age of 17, anything you say can be used against you in a juvenile court prosecution for a juvenile offense and can also be used against you in an adult court criminal prosecution if you are to be tried as an adult.”
For Deaf or Hearing Impaired
REMINDER to officers: A suspect that is deaf or hearing impaired.
- “If you are deaf or profoundly hard of hearing, the New Orleans Police Department has the obligation to offer you an interpreter without cost and will defer the advisement of Miranda Warnings and interrogation pending the appearance of that interpreter. “
The Miranda Rights were provided in the [sign language, etc.] indicated and by the interpreter indicated.
For Limited English Proficiency (LEP)
REMINDER to officers: A person who does not speak English as his/her primary language and has a limited ability to read, write, speak, or understand English is considered as having Limited English Proficiency (LEP). Once the LEP person’s primary language has been ascertained, further communication AND the advisement of Miranda Warnings shall be given using an interpreter.
The Miranda Rights were provided in the language indicated and by the interpreter indicated.
